Supreme Court Judge Justice Ejaz Afzal Khan has said that justice is the foundation and object of any civilised society and nothing can be honorable in a society where there is absence of justice.
The SC judge expressed these views in the certificate-awarding ceremony of a one-week training course on “Skilled Based ADR Training” for civil judges cum judicial magistrates from all over country, Azad Jammu and Kashmir and Gilgit-Baltistan, held at the Federal Judicial Academy/Center of Excellence for Law and Judicial Education, on Friday.
“The greatest challenge that the justice delivery system faces today is the delay in the disposal of case and prohibitive cost of litigation. Alternative Dispute Resolution is thought of as a weapon to meet this challenge,” said the judge.
The primary object of ADR system is avoidance of vexation, expense and delay and promotion of the idea of “access to justice” for all, he saids.
The ADR system seeks to provide cheap, simple, quick and accessible justice, he added.
Justice Ejaz said that ADR is a process distinct from normal judicial process. ADR system is not only grounded in our culture and civilisation but also it is enjoined in our Holy Book, he said.
“It is one of the most attractive options for speedy justice delivery. Collective and coordinated efforts of all main stakeholders of the administration of justice system, coupled with evolving the ADR system in accordance with our indigenous conditions are essential for an effective and swift justice delivery to the litigant public,” the judge said.
