SHC seeks reply from airport high-ups in contempt plea

The Sindh High Court (SHC) on Thursday directed Civil Aviation Authority (CAA) director general, Jinnah International Airport manager and CAA senior manager (commercial) to submit their respective explanations for flouting its order.

A division bench of the SHC headed by Justice Irfan Saadat Khan once again ordered top officials of CAA to maintain status quo with regard to their plan to vacate the site of restaurant at the Jinnah International Airport.

Shabbir Ahmed, operator of the restaurant, filed contempt application impleading Air Marshal (R) Muhammad Yousauf, director general CAA; Muhammad Afsar Malik, airport manager and Ali June Agha, senior manager (commercial) CAA as alleged contemnors.

The applicant submitted that he had entered into an agreement with CAA in December 2012 for running restaurant on the premises of airport for the period of three years. The agreement is to expire in 2015 but the CAA had cancelled agreement illegally on March 27, 2014, and forced him to vacate the restaurant, he added.

He said the cancellation of agreement was illegal as no authority could do so without complying with the terms and conditions of the agreement.

He said earlier on June 06, a division bench of the SHC had ordered authorities to maintain status quo with regard to vacating the restaurant but despite that he was being forced by CAA officials to vacate the restaurant.

He told the bench that despite knowledge of court order, the CAA officials had issued him a letter asking him to vacate the site even though they have set seven-day deadline for him to vacate the site which was sheer violation of the order. So, he requested the court to initiate contempt of court proceedings against them.
