- SHC extends stay orders against election tribunal’s proceedings on petitions challenging results of Sindh CM-won constituencies

The Sindh High Court (SHC) on Wednesday extended till July 7 its stay orders against the election tribunal’s proceedings on the election petitions, challenging results of elections to the constituencies won by Sindh Chief Minister Syed Qaim Ali Shah and other political leaders.
Three-judge bench, headed by Justice Munib Akhtar, extended the stay orders at the request of counsel for the petitioners.
Earlier, the bench had observed that high court had earlier held that it has no jurisdiction to hear the constitutional petitions against interlocutory orders passed by election tribunals, therefore, interim orders would have to be recalled and vacated immediately.
The bench noted that there are related bunch of petitions involving same question whether an interlocutory order made by election tribunal can be challenged in writ petition before high court. This question had earlier come before this larger bench and it had held that such petitions were not maintainable and to be dismissed, it added.
The bench while clubbing together 13 petitions for joint hearing ruled that stay orders granted by the SHC benches against the tribunals’ proceedings would stand recalled and vacated by June 23, if the SC did not pass any order on the question of the high court’s jurisdictions to hear petitions against the order of an election tribunal.
The Sindh chief minister and PPPP lawmaker Nawab Ali Wassan had filed a petition assailing the order of election tribunal regarding maintainability of election petitions against them.
Other petitions were filed by PPPP MNA Ali Gohar Khan Mahar, PPP MPA Abdul Sattar Rajpar and others against the orders of election tribunal.
