LPG case referred to CJP to fix hearing in May

The Supreme Court (SC) has referred LPG case to Chief Justice of Pakistan (CJP) Tassaduq Hussain Jillani for fixing its hearing in next month.

A five-member bench headed by Justice Nasirul Mulk took up Jamshoro joint venture versus Khawaja Muhammad Asif case for hearing Wednesday.

During the hearing of the case, Khawaja Tariq Rahim appeared before the court and took the plea that there are seven findings in the case and the decision was not given by reading correctly the documents on record. Misreading was done. The decision was given without suspending the relevant law. The conditions of the agreement were not looked into while giving decision.

He said bid bonds were issued on September, 12 but the board was not informed about it. Different pre-qualified companies are invited to offer bid. All the bidders have to provide bank guarantee. If some person does not offer bid even then the owners can ask him to do so. The owners have the right to negotiate with the higher bidders. If valuation of any bid is carried out once then SSGL will notify it in writing.

Justice Gulzar Ahmad remarked, “When negotiations are finalized for the agreement even then the negotiations will continue.”

The counsel said, “Yes, the negotiations will continue. Negotiations will continue with successful party at every level till the stage for issuing letter will come. Negotiations will continue till the rejection of bid. We had no experience to run the plant till 12 years from 1998 Threat was given to send Pakistan to Stone Age. I had to spend a handsome amount on new plant. Solid reasons will have to be given now for rejecting the bid because 3 stages had passed. Much will become clear if SSG comes here with record.”

The court while adjourning the hearing for indefinite period sent the case to CJP for fixing next hearing.
