SC issues notices to Maj Amir, his son in murder case

Supreme Court (SC) has issued notices to Maj (r) Amir, member of former negotiation team of government and his son Ammar and others and sought reply from them on a petition filed against their release after having been declared innocent in a murder case.

The court has also directed the investigation officer of the case to appear before it along with record besides ordering that the case be fixed for re-hearing within 15 days.

These orders were issued by a two-member bench of SC presided over by Justice Nasirul Mulk Thursday.

During the course of hearing of the case, Sohail Akhtar, counsel for the family members of victim Khan Muhammad told the court that on February, 14, 2012, Amir, his son Ammar and two others including Subhan Gul and Shahab gunned down Khan Muhammad while Shirin brother of the victim and Imran cousin of the victim were injured in this firing incident.

The case was registered in the respective police station Pahari Pur Peshawar on the same day. But the investigation officer declared Amir and his son innocent. An application was filed in the court of district and sessions judge against this decision. The court directed the investigation officer to initiate proceedings as per law and issue arrest warrants.

He further told the court that the accused challenged this decision in Peshawar High Court (PHC). Upon it the high court set aside the decision of district court against Amir and his son and declared both of them innocent. Petition has been filed in SC upon it.

The court enquired what the present status of the case was.

The court was told that only attendance is being marked since one year. Challan have been worked out and presented but the decision of high court is influencing the trial being run in the subordinate court.

The court while admitting the petition for hearing issued notices to Amir, other accused and ordered for fixing the case for rehearing within 15 days.
