Everyone involved in missing persons’ case to be tried: SC

Justice Amir Hani Muslim on Friday said every perpetrator will be brought to task no matter he hails from army or any other institution.
He gave these remarks while heading a two-member bench of the Supreme Court (SC) during the course of hearing of Balochistan missing persons’ case.
He also said, “Pervez Musharraf’s issue is a different issue from these army officers. Any other court is not authorized to initiate proceedings against serving army officers. CID is only conducting investigation. No other court including session’s court is entitled to conduct their trial. Proceedings against the army officers who have come on deputation can be initiated only on their respective forums.”
The court while rejecting the plea by Nasrullah Baloch, chairman of a social organisation, for formation of larger bench directed him to give application to the chief justice of Pakistan.
The court ruled that the Balochistan government should provide security to Nasrullah Baloch.
The court was told that more headway has not been made in Balochistan law and order case due to ailment of counsel Shahid Hamid, therefore, the hearing of the case be adjourned.
Baloch told the court the authorities have deleted names of six missing persons from the list. The names should be made part of the list again.
Court asked him to submit application on behalf of an affected person.
Irfan Qadir told the court a meeting had been held with Hamid. The issue of FC personnel would be resolved in next meeting. To his view, army officers can be prosecuted only under the Army Act.
Baloch said, “It means federation and province are talking this way to influence Pervez Musharraf case. If army officers are proceeded against under army act then Musharraf will be saved.”
The court said, “Musharraf’s case is different from this case.”
Shah Khawar said, “His motive is not this at all but he wanted to say that decision for initiation of proceedings against the army officers can be taken only by their respective commandants.”
The court sought final explanation from the Balochistan government and adjourned the hearing of the case for two weeks.
