Supreme Court Justice Jawwad S Khawaja on Friday said that the court would recover Masood Janjua if the federal and Punjab governments did not recover him.
He also said the reasons given by the Defence Ministry in writing for not filing affidavits of its retired officers were inappropriate.
He gave these remarks while presiding over a three-member bench during the hearing of missing person case of Masood Janjua.
While giving last chance to the Defence Ministry for filing affidavits of officials of intelligence agencies, including Col (r) Habibullah, Lt Gen (r) Shafqat Ahmad and Lt Gen (r) Nadim Taj, the court warned that if the affidavits were not filed then the court would issue order in this regard.
The court also directed the Punjab government to assign duty of recording and presenting video and audio statement of Dr Munir Imran to a senior police officer and file a report until March 13.
Additional Attorney General (AAG) Tariq Khokhar presented Urdu and English editions of former president Pervez Musharraf’s book which stated that 689 people were arrested during the former president’s tenure and 300 of among were sold out to a foreign country.
Amna Masood Janjua said that Dr Imran Munir wrote on page 8 that Masood Januja was present in a cell next to that of him. The Rawalpindi CPO and SHO Raja Rashid were also present when these statements were being recorded, she said, adding that an FIR was registered in 2010 under the orders of the SC.
Justice Khawaja said, “We fully realise your case. We have to see now what should be our next step.”
Amna said, “My husband has been dubbed as double agent in the news papers and this has pained me enormously.”
Tariq Khokhar told defence ministry had filed a CMA which contains complete explanation about it.
Justice Jawwad rejected the explanation given in CMA remarking this is not a reason in any way. If some one is culprit then arrest him.
Amna said threats were being given to family of Dr Munir and he was ready to tell the whole incident to the court through video link.
Justice Khawaja said, “We have not to do it and principal law officer of Punjab government will do it. Government of Punjab should provide video link.”
Amna said if the government provided protection to Dr Munir then there can be any talk.
Justice Khawaja said, “No, what protection we can provide to anyone in Sri Lanka.”
Punjab Advocate General Mustafa Ramday said, “We are ready to hold video conference of Dr Imran Munir. We can send Haroon Janjua.”
The court said in its orders that Ramday has said that he was ready to send a police officer to Sri Lanka to record the statement of Dr Munir. The Police Department should make all arrangements in this respect so that the investigator could record statement of Dr Imran and include it in investigation.
The hearing of the case was adjourned until March 13.
