SC rejects Musharraf’s review petition against July 31, 2009 verdict

A 14-member bench of the Supreme court on Thursday dismissed the review petition filed by Musharraf’s lawyers against the apex court’s ruling that declared the November 3, 2007’s proclamation of emergency as unconstitutional.
The bench, headed by Chief Justice Tassaduq Jilani, dismissed the plea citing that the time period for filing an appeal had lapsed, adding that the filed petition was not based on merit.

Meanwhile, the special court formed for the trial of former president General (R) Pervez Musharraf on treason charges resumed its hearing on Thursday, a private news channel reported.
The three-member bench of the court, headed by Justice Faisal Arab rejected the request of the former army general’s counsel to adjourn the hearing of the treason case.
Musharraf’s advocate Rana Ejaz had requested the court to delay its proceedings until Monday as his lawyers were engaged in the Supreme Court for the hearing of a review petition filed against the apex court’s ruling of July 31, 2009 which declared Musharraf’s proclamation of emergency of November 3, 2007 as unconstitutional.
The bench rejected the plea and instructed the prosecuting team to present its arguments on Musharraf’s medical report.
Chief Prosecutor Barrister Akram Sheikh termed Musharraf’s medical report a “piece of paper” and unprofessional, adding that 28 days have been passed but the former dictators has not gone under either an ECG or an enzyme test.

Also on Thursday, a plea was filed in a special court for removal of the name of former president General (r) Pervez Musharraf from the Exit Control List (ECL).
The petition contended that the former army strongman wants to visit United States for medical treatment of his heart condition and so, the court may allow him to travel abroad.
