The Supreme Court has been told Wednesday that Masood Janjua and Faisal Faraz, two of the “missing persons” have been killed in fight against Al-Qaeda and they had neither been arrested by the intelligence agencies nor are in their custody.
A three-member bench of the Supreme Court (SC) led by Justice Jawwad S Khawaja had heard this case two days earlier. Affidavits were filed by the government. Additional Attorney General (AAG) Tariq Khokhar had filed these affidavits on behalf of Ministry of Defence.
Former interior secretary Syed Kamal Shah, former National Crisis Management DG Brig (R) Javed Iqbal Cheema and former attorney general (AG) Malik Qayyum told the court in the affidavits filed by them that information have been obtained from all the respective institutions and the ISI in respect of disappearance of Masood Janjua and Faisal Faraz. As per this information, the intelligence agencies have neither arrested Masood Janjua nor is he in their custody.
It was further said in the affidavits that former ISI DG Major General Nusrat had told that Masood Janjua and Faisal Faraz had been killed in fight against Al-Qaeda in Waziristan.
Former AG Malik Qayyum told the court through his affidavit that Deputy Attorney General (DAG) Nahida Mehboob had been appearing in the court in missing persons case. Major General Nusrat Naeem had also told her that Masood Janjua was not in the custody of the ISI and that he had been killed in Waziristan and he had no information in this regard.
