A long-term care facility has agreed to accept a 13-year-old girl who has been declared brain dead but whose family wants to keep her alive, the family’s lawyer said.

Earlier this week a California judge ruled that Children’s Hospital Oakland can take the girl, Jahi McMath, off of life support at 5 p.m. on Monday unless an appeal is filed or a new care facility is found.

On December 9, McMath underwent a tonsil surgery but soon began bleeding heavily from the mouth and went into cardiac arrest.

She was declared brain dead on Dec. 12, news agencies reported.

In order to be transferred to the nursing facility, McMath needs to have a breathing tube and feeding tube inserted, procedures the hospital had thus far refused to perform.
