Indian SC sets aside Delhi HC judgment upturning ban on homosexuality

The Supreme Court of India on Wednesday set aside the 2009 Delhi high court judgement that had decriminalized homosexuality and upheld the Indian Penal code 377, criminalizing gay sex.

The order was  delievered by the top court judges of Justice GS Singhvi and Justice SJ Mukhopadhaya of petitions by anti-homosexuality activists and religious group that had challenged the 2009 HC judgement.

On July 2, 2009, The Delhi high court decriminalised gay sex and ruled that sex between two consenting adults in private would not be an offence.
