The Sindh High Court (SHC) on Monday issued notice to the attorney general of Pakistan (AGP) on a writ petition against proceedings under Article 6 against former president Pervez Musharraf.
A division bench consisting of Justice Ghulam Rasool Sarwar Korai and Justice Abdul Rasool Memon heard the petition.
Petitioner Sohail Hameed said that Article 6 could only be used after the permission of the federal cabinet and a new legislation being made.
However, in the case of Musharraf neither the federal cabinet’s meeting held nor new law was made which was in violation of Article 75 of the constitution, he added in his petition.
