Attorney General of Pakistan Munir A Malik on Wednesday said that there was strong evidence against former president Pervez Musharraf in the treason case.
Talking to reporters in the Supreme Court, he said that the government has decided to initiate trial against Musharraf under Article 6 of the constitution on the basis of solid evidences.
Malik did not rule out that Musharraf could be re-arrested in the case during the proceedings, adding that the Federal Investigation Agency (FIA) would have the authority to carry out his arrest.
According to Article 6, he said, the general could face life imprisonment or death if proved guilty, while he could also be released if no evidences were found against him.
The attorney general added that in the event of Musharraf’s arrest, the jurisdiction of granting him bail would lie with the special court constituted to try the former dictator and that only the president had the power to grant a pardon.
The evidence won’t take long and the decision will be made quickly by the special court, he said, adding that as soon as the special court receives the complaint the FIA will be authorised to make the arrest.
The special court comprising of Justice Faisal Arab (Sindh High Court), Justice Tahira Safdar (Balochistan High Court) and Justice Yawar Ali (Lahore High Court) would try the former army strongman for high treason over the imposition of emergency rule in November 2007.
Meanwhile, the former president has decided to file an application in the Supreme Court to challenge the formation of the special court to conduct trial against him.
