SC bins defence secretary’s appeal against contempt notice

 

The Supreme Court on Monday dismissed Defence Secretary Lt-Gen (r) Asif Yaseen Malik’s appeal challenging the contempt of court notice issued against him for not holding local government elections in cantonment areas.

The Supreme Court rejected an intra-court appeal by Malik and upheld his indictment over contempt of court charges.

A five-member larger bench of the apex court delivered the verdict on Monday

The court upheld a three-member bench’s ruling for a formal charge-sheeting of Malik over his failure to hold local body elections.

The three-member bench, against whom the defence secretary filed an intra-court appeal, was being headed by Chief Justice Iftikhar Muhammad Chaudhry.

The same bench will indict Malik on November 20 for not abiding by court orders.

Earlier, Iftikhar Gillani advocate appeared on behalf of the defence secretary and told the court Malik had to proceed abroad along with a delegation, therefore, he may please be exempted from attendance in the court in this case.

The court accepted the plea.
