The Supreme Court on Wednesday declared the agreement between the Defence Housing Authority (DHA) and the Evacuee Trust Property Board (ETPB) null and void.
In a suo motu case relating to the ETPB land of billions of rupees being sold for peanuts, the three-member SC bench, headed by Chief Justice Iftikhar Muhammad Chaudhry, declared the agreement void and also ordered for initiating criminal proceedings against ETPB Chairman Asif Hashmi and others.
The court also directed the authorities concerned to appoint a new chairman.
During the proceedings, the SC directed the Federal Investigation Agency (FIA) to complete investigation into the case and submit the report to the Registrar’s Office.
The chief justice observed that the ETPB had entered into the illegal agreement with closed eyes, adding that in accordance with the constitution and law trust land could neither be sold nor exchanged with any other land.
