President approves termination of Admiral (r) Fasih Bokhari

 

On the advice of the prime minister, President Asif Ali Zardari on Tuesday approved the termination of Admiral (r) Fasih Bokhari as National Accountability Bureau chairman in accordance with the Supreme Court judgment in a constitution petition No 73 of 2011.

The summary of the Ministry of Law and Justice states that the Supreme Court of Pakistan in its judgment dated May 28, 2013 declared the appointment of Admiral (r) Fasih Bokhari as NAB chairman to be without lawful authority and was set aside with immediate effect.

The NAB chairman, the summary states, had filed a review petition against the order but the operation of the said order had not been suspended.

In light of the decision of the Supreme Court, the Ministry of Law and Justice proposed to the prime minister to advise the president to annul the said appointment from the date when the judgment was passed by the court. Accordingly, the president approved the termination.

On the other hand, Bokhari has filed petition in the Supreme Court seeking staying of the new NAB chairman’s appointment.

Bokhari has prayed the court to hear on July 22 his review petition against its decision on nullification of his appointment as the NAB chairman.

He has taken the plea that if a new chairman NAB was appointed per court’s order, his review petition would stand ineffective and his right to a fair trial would be affected.
