The Supreme Court (SC) has issued detailed judgement in imposition of GST and additional tax on petroleum products case.
The verdict written by Chief Justice of Pakistan (CJP) Iftikhar Chaudhry contains 56 pages.
The verdict read that increase of one percent in GST and charging of nine percent additional tax in respect of petroleum products was declared null and void. The government has been directed to deposit all amount collected under additional GST levy with the registrar SC.
In the detailed judgement, laws of Pakistan, Kenya, Uganda, India and the UK were cited.
The court also nullified section 4 and 5 of 1931 act declaring them alien to the articles 9, 25 and 77 of the constitution.
It was also made clear that additional tax can be slapped after the approval of finance bill from parliament. Additional tax was burden on the people and the people were looted through such steps in the past.
The short order was announced on June, 21.
