SC halts CDA’s operation against construction on agricultural land

The Supreme Court (SC) has halted the Capital Development Authority’s (CDA) operation against construction on agricultural land on more than 4,500 square feet of area.

The SC directed Attorney General (AG) Munir A Malik to obtain directives from the federal government in connection with tampering of the master plan and utilisation of agricultural land for residential purposes and file its reply.

The court directed the CDA chairman to assist the AG in this matter besides presenting a report on those who had been allotted the land for residential purposes.

A three-member SC bench presided over by Chief Justice Iftikhar Muhammad Chaudhry took up the case for hearing on Wednesday.

The CJP said, “People have built swimming pools and posh homes on the precious land allotted for the purpose of agriculture and this way they have defeated the real purpose. People were allowed to do whatever they willed.”

Senior CDA officials told the court that a report in this connection had been filed with it.

The CJP said the CDA undid the court’s decision taken in 2004 by declaring it illegal on its own. The CDA will have to face the implications. Police officers of the IG-level are involved in occupation of lands. Police vans were sent and lands were occupied overnight. Who will compensate for the mistake committed by the CDA board? Should the SC issue an order or will the government find a solution to the problem?”
