SC not too enthusiastic about taking action against Altaf

Refusing to take action against Muttahida Quami Movement (MQM) chief Altaf Hussain, the Supreme Court (SC) on Wednesday postponed the hearing of a case against Altaf’s controversial statements and asked the petitioner to prove the maintainability of the case in the court.

Heading a three-judge bench, Chief Justice Iftikhar Muhammad Chaudhry said that it was not the job of the Supreme Court to take notice of statements that would create law and order crisis in the country as that was the job of the law enforcement and security agencies.

The petition was filed by the Watan Party. Barrister Zafarullah, who represented the petitioner, read out the excerpts of Altaf Hussain’s speech published in newspapers.

Zafarullah accused Hussain of threatening to divide Pakistan.

Chastising the petitioner, the chief justice said that Altaf Hussain should have been made the respondent in the case if his speech was objectionable. The petitioner replied that MQM’s chairman had been named the respondent in the petition.

Continuing to grill the petitioner, the chief justice told Watan Party’s representative that the MQM was “probably” headed by Farooq Sattar, not Altaf, according to Election Commission of Pakistan (ECP) documents.

When the bench was told that Altaf Hussain did indeed head the party, Justice Ejaz said that the Supreme Court could not go after “every party leader making a speech.”

The apex court adjourned the case hearing for one week.

During his speech in Karachi last week when PTI workers were holding a demonstration at Teen Talwar area of Clifton, Hussain made some remarks that created controversy and prompted many Pakistani and British citizens to file complaints at London Metropolitan Police.

Supreme court has yet to decide any case of public interest since the incumbent CJ was restored.All cases of national interest were left pending barring Yousaf Raza Gillani.

    • Suppreme Court of Pakistan can take action on following things against MQM.
      (1) MQM Massive Illegal activities in Karachi, which include Bhatta activities, Killing peoples, Killing Political opponents, Threatening Political oponents.
      (2) Suppreme Court can ask local Law enforcing agencies to arrest people, who killed 11000 citizens in Karachi.
      (3) Suppreme Court of Pakistan can take action againt Law enforcing agencies & Order National assembly to re-organize all Law enforcing Agencies in Karachi.
      Please Note all Citizens of Pakistan. The corrupt Culture of MQM, created in Karachi can spread all over the country…. Suppreme Court should take it very seriously.

  14. Sc will take suo moto on prices of gas, sugar, water and every other irrelevant thing but yet they will postpone hearing on a subject of national interest and security. They will insist on trying Musharraf on treason even when the state has refused to bring those charges against Musharraf but yet they will ignore altaf. What gutter do these judges come out of? Hang them.

This so called disciplined CJ has again after his sons case proven that he can act against and humiliate the investigative agencies for arresting the antinationals but cant act against a goon who invokes terror in karachi since a decade ,against a goon who has held the people and his party workers hostage by his remote speeches,cant act against a goon who openly threatened a country and shown his anti national designs.
    Shame on u CJ,he shall be kicked out ,enough of showing double colors mr choudhary

  16. Looking at the comments coming in and thinking our nation is so into their own agenda's that they can use any words against anyone, if their agenda is not fulfilled. CJ has done many many good things for this same nation but now everyone is calling him names for not taking up this pitty issue at hand. I think we have forgotten one thing here that we are talking about Supreme Court here and not a Court at the corner of the road. What SC has started should be taken up by other smaller courts and continue with it.For some reaons eveveryone thinks now that for any issue they can go directly to SC. Get some life people.

  25. what about Bugties & those Leader of Baloch who want to make Azad Baluchistan… They live in Under the Umbrella of British Government.. Who will take action against him? He is Muhajir that's why people are shouting.. Baloch people are trying to Making AAZAD BALUCHISTAN so long time But there is no one will take the so called Notice…
    Is there not any Justice for Urdu speaking people in Pakistan. just think about it..
