Overseas Pakistanis face disappointment as SC disposes of case without allowing them to vote.

After wrangling with the government for two years to give expat Pakistanis the right to vote, the Supreme Court  (SC) on Monday swallowed a bitter pill in the face of caretaker government’s standard response: no legislation and no mandate for enacting legislation. Ending a suspenseful saga over rights of overseas Pakistanis to vote, the Supreme Court disposed of the case, saying if the government did not want to pursue the case, so be it.

According to details, a three-member bench of SC headed by Chief Justice Iftikhar Muhammad Chaudhry took up overseas Pakistanis right to vote case.

During the course of the proceedings, the attorney general (AG) told the SC that it was impossible for the interim government to extend electoral facilities to the overseas Pakistanis as its mandate was to hold transparent election.

The AG told the bench that the caretaker government had been mandated to hold a free and transparent election and that extending rights to overseas Pakistanis was a policy decision which was beyond its term of office. However, he assured the court that facilities and legislation would be in place for next elections where overseas Pakistanis would be able to cast vote.

He said that obtaining legislation to allow overseas Pakistanis to vote was a time-consuming process and there simply wasn’t enough time to obtain the required authorisation before May 11.

Moreover, he said that even though the foreign ministry and other institutions had given a green signal for overseas Pakistanis to vote, it was too late to obtain legislation.

The court disposed of the case maintaining that it was very difficult to give right to vote to overseas Pakistanis in view of reply of the federation and shortage of time. The bench observed that the federal government should ensure steps for making overseas Pakistanis part of electoral process through legislation in the next elections.
