Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry on Monday said rule of law and constitution would prevail in the country and no one could be kept under illegal detention for even a second now, asking the country’s spy agencies to correct their attitude.
He gave these remarks while presiding over a three-member bench of hearing the Adiala missing prisoners’ case on Monday.
The Khyber Pakhtunkhwa additional advocate general filed a reply, but the court expressed its dissatisfaction over it.
During the course of hearing, the CJP remarked about two missing persons, including Muhammad Ibrahim and Mirsas, who were taken away from Malakand.
“Only rule of law and constitution will prevail now at every cost. No one can be allowed to violate law. No one can be kept under detention illegally for even a single second now. Intelligence agencies should change their attitude now. No one is supporter of terrorism”.
Justice Gulzar remarked, “Under what law army lifts innocent people from FATA and why are they not presented before a magistrate.”
Lawyer Aasma Jahangir said, “The army is persistently violating Article 9 of the constitution in FATA and PATA, while under Article 10, the detained person has to be presented before a magistrate but it is not being done so. Uncertainty is gripping the people.”
The court ordered the KP government to recover Muhammad Ibrahim and Miras Shah and produce them before the court.
It also sought a reply from KP additional advocate general KP on deployment of army in PATA and breach of Article 9 of the constitution, adjourning the proceedings until May 2.
Otherwise I am here to protect them by giving false impression as if I am taking them to task.
