No more excuses: SC refuses to give more time to the federation in Musharraf treason case

The Supreme Court of Pakistan on Wednesday refused to give more time to the federation to submit a response for five identical petitions seeking prosecution of former president Pervez Musharraf for abrogating the Constitution.

According to details, Attorney General (AG) Irfan Qadir had been directed by a division bench of the apex court comprising Justice Jawwad S Khawaja and Justice Khilji Arif Hussain to explain if the Article 6 of the Constitution applied to former president General (r) Pervez Musharraf for high treason and come up with a reply of the federal government in writing through a concise statement by April 17.

The government, however, failed to come up with any response and the court turned down its request to grant one week’s time.

Sources said that although consultation between the AG and the Law Ministry took place, no decision could be taken due to difference of opinion.

The AG, during Wednesday’s proceedings, said that the current government was part of caretaker setup and its limited mandate was to conduct free and fair elections. He further said that such an action should not affect the fairness of the caretaker government.

Justice Khilji Arif remarked that the court’s orders had not been given due importance and that the caretaker government should have taken a serious note of the SC’s ruling in the case.

Musharraf’s lawyer Ahmed Raza Kasuri said that judges were also included among those who supported Musharraf. Replying to this, Justice Jawwad S Khawaja said that they were ready if federation wanted to initiate trial against them.

    (2A) An act of high treason mentioned in clause (1) or clause (2) shall not be validated by any court including the Supreme Court and a High Court.

    Looks to me that the judges are equally guilty of treason because the validated Musharraf's rule.Hmmmmm.

  3. I have no sympathy for Musharraf but I do have some questions for the SC:
    – Didn't most if not all judges validate Musharraf's coup?
    – Shouldn't Nawaz Sharif also be tried under the treason act for not allowing Musharraf's plane to land in Pakistan, which eventually started the coup?
