The Supreme Court on Tuesday classified the applicants in the dual nationality case in six different categories and asked all the former parliamentarians to furnish arguments according to their respective category.
On Tuesday, a two-member bench under the supervision of Justice Jawad S Khawaja heard the dual nationality case in which the counsels of 20 dual nationality holders appeared before the court.
Barrister Faroogh Nasim told the court that his clients and MQM’s parliamentarians Raza Haroon, Haider Abbas Rizvi, Syeda Tayyba Hussain, Abdul Hameed Siddiqui and Nadim Ahsan have been asked to return all the perks and salary, but they are not in a position to comply with the orders.
He said that the tenure of the assembly has finished so no action could be taken against the former MNAs and MPAs
At this, the court said that the bench would put the applicants in six different categories.
“Separate hearing would be held for every group and each of them would give arguments during their respective proceeding,” the court added.
The first category comprises all those people who are dual nationals by birth; Doniya Aziz and Arif Aziz Sheikh fall in this group.
Second class would be comprised of those member of the parliament who tendered resignation before the expiry of assembly tenure; Sabeen Rizvi, Irish Kumhar, Sadiq Memon and Murad Ali Shah are in this group.
The third group consists of all those parliamentarians who did not give in their resignations till the last day of the assemblies. These parliamentarians have been asked to return all the pay, allowances and perks back to the national exchequer, which they received during the last five years as MNAs and MPAs.
The fourth group will be of those people who could not return their salaries and perks due to weak financial position and the sixth category comprises those members who gave up their dual nationality.
The court postponed hearing till May 2.
