Kamran Faisal case: NAB voices reservations regarding the bench

National Accountability Bureau (NAB) Prosecutor General KK Agha said on Tuesday that he has reservations with regard to amicus curiae and the Supreme Court (SC) bench hearing Kamran Faisal’s murder case.

A 3-member bench of SC led by Justice Jawwad S Khawaja took up NAB officer Kamran Faisal’s murder case on Tuesday.

During the course of the hearing NAB Prosecutor General (PG) KK Agha said he had reservations with regard to amicus curiae and courts’ proceedings.

“It appears from media reports that the court is biased and objections are being raised over NAB’s performance. It is better that the sitting bench does not hear this case. There is one judge among the members of this bench who has already heard this case,” he said.

Aftab Bajwa, counsel of Kamran Faisal’s father, on the other hand said Kamran Faisal murder is being given the color of suicide deliberately despite the fact that his pictures taken at the time of his death were released by NAB and they are not close to the actual facts.

“On the other hand, pictures and his email address are of paramount significance and these can be used as strong evidence as circumstantial evidence,” he said.

At this, the court remarked that Bajwa should contact the investigation officer in this regard and provide him with evidence.

 

Amicus Curiae Anwar Kamal said investigation into the case was still underway.

“Let the investigation officers complete their work. The original forensic report has not reached the SC and only its copy has been sent,” he added.

KK Agha said the trial court heard the murder case and the SC could not hear it.

Justice Jawwad S Khawaja said, “We have to review this case in this perspective if this murder or suicide case has linkages with rental power case.

Aftab Bajwa presented pictures of the late Kamran Faisal in the court which were taken at the time of his death.

“Six injuries inflicted on the body of the deceased have not been shown in the report. The evidence was destroyed,” he said.

“NAB raised no objection for the last four months over Kamran Faisal father becoming a party to this case and now it has started raising objections over it,” he added.

Amicus curiae said that the evidence so far found reflected that it is case of suicide.

Meanwhile, the court observed, “We don’t want to say some thing with reference to it. We want to bring the case to its logical conclusion”.

When Aftab Bajwa reiterated that the evidence had been destroyed, the court remarked, “You are important to us. We want to know the actual facts of this case. Therefore, we are adjourning the hearing of this case till May 16 so that we could review the matter related to the blame of a biased bench”.

Justice Jawwad S Khawaja said, “This killing is either a suicide or a murder; it is not a natural death”.

Court ordered the NAB and the police to investigate the matter independently and freely and present the report on May 16.

Hearing of the case was adjourned till May 16.
