Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry has said Pervez Musharraf was in Pakistan and if someone had the courage, he should come forward and initiate proceedings against him.

A three-member bench of Supreme Court (SC) presided over by CJP took up the Adiala jail prisoners and FATA Regulation case on Wednesday.

Ghulam Nabi advocate appeared on behalf of professor Ibrahim and Tariq Asad advocate represented Adiala jail prisoners in the court.

Counsel for professor Ibrahim took the plea that FATA regulations were illegal and unconstitutional and they were blatant breach of human rights.

“During his tenure, Musharraf took stern action against innocent people by launching military operation. Several innocent people were killed during the operation. Several are still under arrest and no one among them has been presented in the court. Their fate has not been decided as yet,” the counsel submitted.

The CJP remarked, “Musharraf is in Pakistan at present. Whosoever wants can initiate proceedings against him. If someone has courage he should come forward and initiate proceedings against him. Everyone has the opportunity. Should the court do every job?”

The court was informed that prisoners of Adiala had been shifted to Kohat jail.

The accused are facing cases of keeping illegal arms and involvement in kidnapping and murder.

The court observed the case will be heard in detail and adjourned the hearing until April 8.
