Justice Nasirul Mulk detaches himself from NRO implementation case

Justice Nasirul Mulk on Tuesday detached himself from the Supreme Court (SC) bench hearing the NRO implementation case and the issue of formation of a new bench has been referred to the Chief Justice Iftikhar Muhammad Chaudhry.

A three-member SC bench, led by Justice Mulk, had taken up the NRO verdict implementation case on Tuesday.

Justice Mulk said he was detaching himself from the bench as he had already rendered a verdict on similar legal and constitutional points in the Peshawar High Court. “Therefore it is not appropriate for me to sit in this bench,” he added.

The NAB prosecutor general requested the court that the proceedings be adjourned for a month or until the formation of a new bench.

The court granted the NAB PG plea and adjourned the hearing of the case for an indefinite period.

Waseem Sajjad, counsel for Malik Qayyum, appeared in the court and requested that name of his client be struck off from the case as the court had already given a decision on the review petition.

The court rejected the plea and remarked that it could not say anything on the matter. “As the bench stands broken due to separation of Justice Nasirul Mulk, the case will be heard by some new bench. Matter is being referred to the CJP.”
