LHC advises parliament to consult constitution regarding new provinces

The Lahore High Court (LHC) on Friday during hearing of petitions questioning legal status of a parliamentary commission on creation of new provinces remarked that the parliament must stay within its constitutional provisions.

During the course of proceedings, the leading counsel for the petitioners argued that neither the constitution nor the rules of business allow the commission to form new provinces, adding, that the formation of parliamentary body is unconstitutional.

The counsel told that people in Mianwali are staging strikes to record protest against the recommendations of the ‘illegal’ parliamentary commission. The counsel warned that situation may worsen if recommendations of the commission are not suspended.

Meanwhile, the additional attorney general informed the court that a unanimous resolution for the formation of commission had been passed in the National Assembly.

The LHC Justice Khalid Mahmoud Khan said that the parliament has the right to form ‘new’ laws but that doesn’t imply that the institution hands over the entire country to India.

The court summoned the summary of the resolution from the federal government by March 5 and adjourned the hearing.

  1. The respected judges are so very right. As a common man from Pakistan my biggest fear has been about the enemy within, an enemy may not be through the mala fide intentions but thorough sheer lack of foresight and judgment with which our politicians are brimming to the top.
