The Supreme Court Tuesday set aside dismissal from service orders of executive engineer snd Sub divisional officer, Punjab Works and Communication Department.
The counsel for the petitioner Hafiz Tariq Nasim argued that petitioners Xen Khalid Hamdani and SDO Nawazish Ali Shah were dismissed on the alleged embezzlement charges of Rs 6.6 million in the construction of a bridge at the Tavi River in Sialkot.
Continuing his arguments, the counsel said that the Punjab Service Tribunal (PST) had reinstated the petitioners into service on merit in the light of findings of the enquiries but the Communication Department had approached the apex court against the PST.
The counsel said that the department had conducted three enquiries and their findings were altogether different. In the last enquiry it was reported that the department had suffered a total loss of Rs 2 million and not Rs 6.6 million which had been recovered from the surety bonds of the contractor and had recommended one year promotion stoppage of the petitioners.
The SC bench comprising Justice Tasadaque Hussain Gilani and Sarmad Jalal Usmani, agreeing with law point, set the dismissal from service order aside and upheld the penalty of seizure of one year service of the petitioners.
