The ‘Fair-Trial Bill 2012’ was presented in the National Assembly on Thursday. The bill tabled by Law Minister Farooq Naek was presented despite opposition from the MQM and PML-N.
The bill had already been approved by the NA Standing Committee on Law and Justice. The proposed legislation is set to formally pave the way for the government to tap phones and use e-mails and text messages as proof in trials.
The legislation in question provides authority to the government that it can access “data, information or material in any documented form through audio visual device, CCTV, still photography, bugging, observation or any mode of modern devices or techniques obtained under the Act … documents, papers, pamphlets, booklets” for surveillance.
The government can also intercept “emails, SMS, internet protocol detail record, call detail record and any form of computer based or cell phone based communication. It also includes any means of communication using wired/ wireless/ internet protocol-based media/ gadgetry.”
THIS IS THE GOOD MOVE FOR THIS TIME . BUT IT WILL BE USED FOR THE POLITICAL VICTIMIZATION AS WELL AS FOR PERSONAL GRUDGES BY THE POLICE AS IT IS THE COMMON PRACTICE IN PAKISTAN. PEOPLE ARE CRUSHED TO GET A JOB IN PAKISATN LAW ENFORCEMENT AGENCIES JUST FOR THEIR OWN INTEREST. I AM SURE NOW POLICE OFFICERS WILL TAKE GET JAGGA TAX, IF THERE IS ANY DENYING, THIS ACT WILL BE EXERCISED.
It is good effort by the National Assembly, due to development in IT, improvement in law is need of time. Thanks God, batter sense prevailed and finally the government
brought a good law. So for as abuse of process of law is concerned, no law is perfect and High courts and supreme court always correct shortcommings of law through collective visidom of lawyers and Judges.
