LHC disqualifies PML-N MPA over dual nationality


Lahore High Court Chief Justice (CJ) Umar Ata Bandial on Friday disqualified PML-N Member Provincial Assembly (MPA) Rana Asif for holding dual nationality.
The CJ ordered the Election Commission of Pakistan (ECP) to de-notify Asif as a member of the provincial legislature. The CJ passed the order on a petition filed by Faisal Ilyas Sadiq through his counsel Saif-ul-Malook seeking disqualification of the MPA over dual nationality. The petitioner submitted that Asif was a Muslim but was elected as MPA in Punjab in the 2008 general elections against a seat reserved for non-Muslims. The petitioner, expressing concern over dual nationality of Asif, pleaded the court to issue directions for his disqualification. However, Asif in his reply submitted that he had a Canadian passport but was not a citizen of Canada as the status was revocable. Therefore, he could not be disqualified under article 63 (1), (C), of the constitution, he contended.
The court, after hearing arguments of both parties, disqualified Asif in light of the Supreme Court verdict on the matter and article 63 (1), (C) of the constitution. The court had already suspended the membership of Asif over dual nationality and the CJ had also barred him from attending the Punjab Assembly session.
