Courts can’t proceed against serving army personnel: IHC

The Islamabad High Court on Friday observed that the court could not proceed against serving army personnel, as army employees did not fall within the jurisdiction of civilian courts under the Article 199(3), which placed a bar upon courts to take up such issues. A single member bench of IHC comprising Justice Muhammad Anwar Khan Kasi passed the remarks while hearing a case related to financial dealing between Major Zubair and Yawer Saeed Khan. The bench also directed the counsel for the petitioner to delete the Adjutant General of Pakistan Army from the list of respondents as there was specific bar contained in Article 199(3). During the course of hearing, counsel for petitioner apprised the bench that an FIR was registered against Major Zubair in the case of financial matters.
He prayed the court to direct the Adjutant General of Pakistan Army (GHQ) Rawalpindi to hand over Major Zubair to the police as an FIR was registered against him in the financial matters amounting to Rs 24 million.
The hearing was adjourned until date in office.
