The Supreme Court, acknowledging the objections raised by real estate tycoon Malik Riaz over the judicial bench, on Wednesday declared that the review petition will be heard only when the two-member bench is available for the purpose.
It is worth noting here that the counsel of Malik Riaz, Zahid Hussain Bukhari, during the previous hearing, pleaded the court against the constitution of a new bench; as according to him, the same bench which had given the August 30 decision should hear this matter.
The apex court’s three-member bench headed by Justice Jawwad S Khawaja, heard the review petition filed by Riaz against Dr Shoaib Suddle Commission, which is probing a business deal between Dr Arsalan and Hussain. The other members of the bench are Ejaz Afzal Khan and Chaudhry Ijaz Ahmad.
The bench reserved its judgment over Bukhari’s objections put forward during Tuesday hearing.
The court consenting to his objections, remarked the hearing of the case will take place only when the original two-member bench which gave August 30 decision, will be available.
