Judges required to protect, defend constitution: CJ

Chief Justice Iftikhar Muhammad Chaudhry on Monday said judges were required to preserve, protect and defend the constitution of Pakistan. Addressing the opening ceremony of the New Judicial Year 2012-2013, Justice Chaudhry said that the rule of law is the only solution to all social and economic problems and that the Supreme Court is striving to discharge its constitutional duty of securing the principles of democracy, equality, freedom and social justice as enunciated by Islam.
The chief justice said that absence of justice in a society gave rise to denial and infringement of rights of men, which in turn led to chaos and anarchy. “When might becomes right, the entire fabric of the society is rendered fragile. Resultantly, people are compelled to take the law in their own hands. Therefore, using the modern terminology, upholding the supremacy of the constitution and rule of law is the only solution to all social evils and economic problems,” he added. He said that Islam aimed at establishing a society where there was no one above the law and all persons whether high or low, powerful or weak, rich or poor – all were equal before law, and equally treated. CJP Iftikhar Chaudhry emphasized that attention was needed for a better understanding of problems confronting the system of delivery of justice that were threatening the rule of law in the country. He said that the judiciary had a primary role in the justice delivery system. However, all the authorities and institutions, including executive and the legislature, had to render auxiliary support and cooperation in the administration of justice and execution of the judicial process.
The principle of trichotomy of powers embedded in the provisions of the Constitution aims at creating an atmosphere of harmony and collaboration among all the state institutions in order to achieve the goal of fair dispensation of justice, he said. “The judicial activism on the part of apex court has not only improved the judicial system as a whole, but has also enhanced public trust and confidence in the institution,” he noted. He said that the obligation of protecting and defending the constitution is cast on all government/public office holders and elective office holders in the national interest.

  2. You are abusing constitution Mr. Chief Justice not defending. In a democratic system Parliament is always supreme and sovereign, It is the spirit and essence of democracy. Now if Parliament is supreme it means that it must have authority to take all the decisions but unfortunately, Judiciary is usurping this right. In all the countries where law rules, Parliament is authority to make appointment of judges but unfortunately the way Chief justice adopted was totally against the rule of law and essence of democracy. The compulsion to consult Chief justice simply gives Chief Justice a choice to appoint judges of his own choice. The question is either the same way is followed in the civilized world?Iftikhar Chaudhry must hold his horses?. The recent move by CJP raises some serious questions? Does Iftikhar Chaudhry want his hegemony on Judiciary by handpicking judges? What are his aims by appointing judges of his own choice?. Does he want decisions of his own interests by appointing his close associates? Does chaudhry working according to essence of long and toiled campaign, for his restoration? Is it not the violation those principles, that raised him as a hero? These are all serious questions which must be answered. Not only Pakistani people but foreign media is also pointing fingers at current Judiciary. BBC in one of its recent article accused Iftikhar Chaudhry for bequeathing his relatives and a special group. U.S wall street Journal while commenting on recent war on the democratic Govt by Judiciary said that, adventure against Zardari makes Judicary controversial, adding that interference in political matters constantly negating Judiciary true role. After the recent development, the nation is force to think that Iftikhar Chaudhry has become a strong ally of Mian Nawaz Sharif. Judiciary is making mockery of this nation and mandate of people of Pakistan. I guess this man would give indispensable loss to this country.

  3. Mr. Iftikhar, you are one of the most power CJ of Paktistan. You have not been able to deliver in your own area of responsibility how can you defend the constitution of Pakistan. I have seen the conditions of lower courts and high courts with innocent people begging for Justice and the delay in the cases. Cases pending for decades. Please work and work hard in your area od responsibility rather than talking big words using Difficult ENGLISH.
