Judiciary can go to any extent for rule of law: CJP

Chief Justice of Pakistan Iftikhar Muhammad Chaudhry has said that the judiciary could go to any extent for implementation of the constitution. Addressing an Iftar dinner and farewell party in honour of Justice Shakirullah Jan, the chief justice said external factors did not affect the verdicts taken by a judge. “The function of the Supreme Court is to maintain rule of law and superiority of the constitution,” adding that the “judiciary is bound to shoulder its responsibility as a significant pillar of the state”.
He made it clear that the verdicts of judiciary were not taken while keeping in view special personalities, vowing that the judiciary would continue to make judgments without any pressure at every cost. The CJ said the Supreme Court got guideline out of law and the constitution. “It should be made mandatory that the all the institutions should work while living within their jurisdiction,” he said. Speaking on the occasion‚ Supreme Bar Association President Yasin Azad expressed concern over the prevailing situation and said the country was heading towards a constitutional crisis.

  1. What kind of CJ is this one who can not go sleep without making a political speech. He should better quit & take part in active politics if he is so fond of politics.

  2. He should first of control his son and straighten his own house . He seems to be the most political head of Supreme court.

  3. Instead of making speeches, sermons and statements justice belives in action.
    My question a) Why the convicted and criminals are holding top executive positions?
    b) what is stopping you now to kick them?
    Disqualify all whoever has even slightest corruption allegations, convicted or a criminal irrespective of party PPP, MQM,PMLN,ANP,JUI,PTI etc

  4. Zardari ne is mulk ko tabah kar diya hai. Shame on all those politicians who r supporting his corruption. They won elections by putting big statements against NRO and now they all defending it. CJ is our last hope in this fight of Good Or Bad. Rule of law is the only option. Otherwise these thugs will keep ruining country as per their filthy actions.

The SC has neither taken account of presidential immunity under Article 248, nor, except in passing remarks about those seeking immunity having to apply to the court for it, attempted an interpretation of this Article. The government side has seemingly been reluctant to be drawn into an argument over Article 248, probably because it is its perception that it will not receive a sympathetic hearing from the SC, rather the reverse. The court’s insistence has begun to invite criticism of its approach, not the least from former Supreme Court Bar Association (SCBA) president Ms Asma Jahangir, whose words reflect the mounting anger against the judiciary in some legal circles. She has squarely accused the judiciary of delivering political rather than judicial verdicts. Her statement is lent at least partial support by the present SCBA president Yasin Azad, who has suggested to the court that perhaps the best solution to the conundrum is for the court to set up a commission to write the by now infamous letter. He has also pointed to the political and economic instability being caused by the air of uncertainty this standoff is producing in and around the country. Perhaps the middle way is not only the best, but also the only way out of this impasse.
