Chief Justice Iftikhar Muhammad Chaudhry on Tuesday rebuffed the government’s assertion that new Contempt of Court Act was free from flaws. A five-judge bench of the apex court, headed by Chief Justice Iftikhar Muhammad Chaudhry and including Justice Shakirullah Jan, Justice Khilji Arif Hussain, Justice Jawwad S Khawaja and Justice Tassaduq Hussain Jillani, resumed hearing in 27 identical petitions challenging the Contempt of Court Act, 2012. Abdul Shakoor Paracha, the federation’s lawyer in this case, requested the Supreme Court to refer the petitions to high courts instead of taking them up directly. Justice Khawaja asked whether a new Pandora box should be opened by referring the matter to five high courts. Paracha said parliament has complete right of legislation under the constitution and this authority could not be challenged.
He termed the petitions as non-hearable. Paracha moreover argued that the new contempt of court law did not in any manner restrict the powers of the judiciary. The chief justice said democracy would continue if dictatorship was not supported. The court also reprimanded the attorney general for his inference during the hearing and asked him to wait for his turn. Justice Shakirullah Jan in his remarks said the Contempt of Court Act was a discriminatory law which gave protection only to a particular class of society. When Abdul Shakoor Paracha said the opposition leader in the parliament started making speeches over the remarks of the judiciary, Justice Jawwad Khawaja said the opposition leader expressed his own views. In his arguments, Shakoor said the “new law has not alleviated the judicial powers”. Justice Shakirullah Jan said the basic rights had been violated by giving privilege to the elite class in the new law, which was why the newly-endorsed law was discriminatory. Chief Justice of the Supreme Court asked the federal government’s counsel if this matter was not of national importance, everyone should know that one of the prime ministers of Pakistan, Yousaf Raza Gilani, was convicted and disqualified over contempt of court. He told Shakoor that the lawyer himself accepted that Section 12 of the contempt of court law was faulty, then how could the federal government say the law was not a matter of people’s concerns. The chief justice told the lawyer of the federal government that not only the common people, but the Pakistan Bar Council had also challenged the new law.

I wonder How Mr. Peracha became Constitutional law expert. While judge he had been hearing bail applications or matters of extreme low importance. This time Federation would sink due to his professionalism. Once Baber Awan said in his court that the cause list pasted outside his court was rate list. How it is happy to note that after retirement he would enrich himself with heavy fee.
