Chief Justice Iftikhar Muhammad Chaudhry on Tuesday said there was a constitutional breakdown and a complete lack of order in Balochistan.
Resuming hearing in Balochistan law and order case, the three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry said, “The court’s orders are not being obeyed and administration has not been able to implement orders.”
The bench expressed annoyance over the absence of the provincial chief secretary. Justice Chaudhry said judicial orders were not being implemented and the court could summon the PM’s principal secretary because the civilian administration, police, FC and the army had not been able to resolve any single issue so far. The provincial interior secretary presented in court the inquiry report of the abduction and killings of coal miners, telling the SC that they had arrested two accused involved in the case. Raja Irshad, the counsel for spy agencies, told the SC that the people wearing FC uniform carried out the attack on coast guards. In a written statement, Irshad said the agencies had conducted “internal inquiries” and found the group of missing people “was not held in the custody of FC”. It said in many cases, insurgents dressed in FC uniforms committed “high profile acts of terrorism and heinous crimes… thus bringing a bad name to this federal organisation”.
The chief justice said he was not satisfied with the FC’s reply. “There is an apparent failure of the executive machinery to control law and order,” the CJ said. “Tell us straight that you have done nothing in the case, you have put your hands up, no force, including the Inter-Services Intelligence (ISI) and Military Intelligence, are working properly. We have been seeking resolution for the last six months, but the result is still insignificant,” the chief justice added.
“The Balochistan chief secretary will have to write to SC that the administration has failed to maintain law and order,” the CJ added. Later, the court wrote in its order that constitution was not being implemented and demanded answers from the provincial and federal governments. The court then adjourned the hearing until today (Wednesday).
