Balochistan case: SC says no institution is performing its duties

The Supreme Court, on Wednesday, stated no institution was performing its duties in Balochistan and FC, police, spy agencies and provincial government have failed in order to restore law and order in the province.
A 3-member bench of the apex court, headed by Chief Justice Iftikhar Muhammad Chaudhry, heard the proceedings of the case of law and order situation and human rights violations in Balochistan.
The chief justice directed the counsel of the federal government that after the failure of provincial government, it was constitutional duty of the federal government to control the situation.
Justice Jawad S Khawaja stated, “If local government elections were conducted in Balochistan, perhaps the situation could be better, not a single target killer has been arrested, the abduction for ransom, target killings and smuggling are being done openly”.
Shakoor Paracha, who is the counsel of the federal government, stated that provincial government can only be directed by the federal government.
Justice Khilji Arif Hussain stated that no one was ready to get its responsibilities, provincial government was not doing anything significant, it was the duty of the federal government to control the situation.
Justice Jawad S Khawaja stated it was the duty of the administration to make implementation possible of judicial orders.
The bench asked Supreme Court Bar Association’s President Yaseen Azad for the judicial cooperation to come to rostrum.
Yaseen Azad, while referring joint resolution over the Balochistan issue with cooperation of the local Baloch people, stated that in light of that resolution, the law and order situation could be improved if political solution would be taken into consideration of the Balochistan issue.
He stated that he had written letters to president, prime minister and National Assembly speaker but he had not got any reply so far.
He stated that Baloch people wanted exclusion of FC from the province because people and police opined that agencies picked people from the police stations.
“The people of Balochistan want the immediate end of role of agencies from the province and all political parties are agreed over the political solution of the issue”, Yaseen Azad stated.
During the hearing, Advocate General of Balochistan Amanullah Kinrani presented report over the Balochistan issue and stated, “The provincial government is very serious for resolving Balochistan issue and asked for more time for the implementation of judicial orders.”
The chief justice stated, “How much time court has to grant to the provincial government, because they only ask for more time and not serious for resolving issue.”
The court then summoned a report on the Balochistan issue from federal government, provincial government of Balochistan, FC, army and spy agencies. Later on, the court adjourned the hearing until Thursday (today).
Earlier on Tuesday, the bench had ordered the federal and Balochistan governments to admit in writing that they had miserably failed to establish the writ of law in the strife-torn province and Chief Justice Iftikhar Muhammad Chaudhry stated there was a constitutional break down in Balochistan.
