No political cell can work under ISI: SC

Supreme Court of Pakistan has issued second order against possible political cell in ISI in Asghar Khan Case on Monday.
A three-member bench of the Supreme Court headed by Chief Justice Iftikhar Muhammad Chaudhary heard Asghar Khan Case.
While hearing the case, Chief Justice Iftikhar Muhammad Chaudhary remarked that Inter-Services Intelligence (ISI) distributed funds among the politicians while it had no right to sway any government using national exchequer.
Supreme Court in the judicial order has directed the Prime Minister to bring to the notice of all that a political cell cannot work under ISI, even if it was done in the past.
The judicial order also referred to its Supreme Court’s order of July 31.
The order of July 31 had recommendations about the political cells.
When Attorney General questioned about working of the political cell, Justice Khilji Arif Hussain said it has been written in the court order that a political cell cannot operate under any law-enforcing agency.
The court was told that defence ministry and cabinet division did not succeed in bringing up the notification of political cell.
Chief Justice asked who will represent the defence ministry, Military Intelligence (MI) and ISI in the case, and if the Director Legal Affairs of defence ministry will represent all the institutions.
At this Secretary Defence Nargis Sethi said Director Legal Affairs has told her that ISI and MI will have their own representatives, and she can give details after getting relevant direction.
Chief Justice said no lawyer from defence ministry has appeared before the court.
He said the court would give chance for explanation to everyone.
He noted ISI is answerable to the Prime Minister.
Chief Justice Iftikhar Chaudhary ordered the Attorney General to analyze the summary of General Asad Durrani about the political cell of ISI, or otherwise the summary must be sealed and produced in the court.
He said the Supreme Court wanted to bring forth the facts in a transparent manner.
During the hearing, Justice Khilji Arif Hussain said the court was told that the documents by ISI also reached office of the Attorney General.
At this Attorney General Irfan Qadir said he would look for the documents in his office.
It has also been written in the judicial order released on Monday that the democratic process will continue without any extra-constitutional interference.
While hearing the case, the Chief Justice said democracy and democratic institutions must be strengthened.
There can be no introduction of the Bangladesh Model in the country, Chief Justice Iftikhar Chaudhary remarked during the hearing, adding that no one can harm the country if there were no weaknesses in us.
The Chief Justice said there should be no compromise on national security, and whoever is involved will have to suffer.
