SC pulls the plug on PM

The Supreme Court on Tuesday ruled Speaker National Assembly Fehmida Mirza’s ruling as void and declared that Prime Minister Yousuf Raza Gilani stood disqualified since April 26.
“Yousuf Raza Gilani is disqualified from membership of parliament from April 26, the date of his conviction. He has also ceased to be the prime minister of Pakistan,” said Chief Justice Iftikhar Mohammad Chaudhry, reading the order.
“The Election Commission shall issue a notice of disqualification and the president is required to take necessary steps to ensure continuation of democratic process,” he added.
A three-member bench, comprising Chief Justice Iftikhar Mohammad Chaudhry, Justice Jawwad S. Khawaja and Justice Khilji Arif Hussain heard a set of constitutional petitions challenging National Assembly Speaker Fehmida Mirza’s ruling over the reference against Prime Minister Yousuf Raza Gilani.
The bench had been hearing a set of petitions filed by the Pakistan Muslim League-Nawaz (PML-N), the Pakistan Tehrik-i-Insaf (PTI), Azhar Chaudhry advocate and others challenging the speaker’s ruling of May 24 over the qualification issue.
Earlier during today’s hearing, Attorney General Irfan Qadir presented in court the National Assembly’s resolution endorsing the speaker’s ruling. The resolution had been moved by the government and was adopted by the NA on June 14.
“We respect the courts, however, state institutions should try to avoid clash amongst themselves,” the attorney general said.
Upon which the chief justice remarked that the judiciary respected the parliament and that there was no clash between the state’s institutions.
Justice Khilji remarked that the court’s duty was to interpret the law and the constitution and to stop all measures which violate these.
Qadir said that if the court issued an order against the speaker’s ruling, the parliament would declare it invalid.The prime minister is not answerable to the courts over the dispensation of his professional duties, the attorney general said.

  5. I am not taking any partisan position on this issue and I never did, but this I feel is a blow to the democratic process. Looks like personal vendettas have taken over the political process. We may end up with another military coup down the road if politicians and judges do not behave in a rational manner.

      • Why do you abuse people. What do you achieve by using abusive language. What imran did it is his personal life. Do you know that Bhutto was a great leader. I always admired him. He used to sleep with wives of his ministers. It was personal between him and those women. Bhutto used to drink alcohal. In open Jalsa he once said that " Mein Sharab peeta hun logon ka khoon nain Peeta" People never held this behaviour against him The point is we all make mistakes. I am sure you also made a lot mistakes in your life.
        Once again my advise, Abusing people will not take you any where.

        • By abusing them I want to give them shock becoz they r victim of propaganda and wrongly think that everything will improve. My views are also confirmed by foreign media. Just read Newyork Times who did not portray it as judicial decision. Other foreign media also says the same because they r not part of our emotional situation. Interference in democratic evolution by non-political forces in the past has brought us to the present situation.

You have nothing to put against Imran so do his character assassination. When Nawaz Sharif fled to Saudia what Benazir did then… She fled to Dubai… Your Zardari should have been disqualified as he himself submitted a certificate to Swiss courts that he is abnormal and cant appear in the court in his money laundering cases.   9. We want General Waheed Kakar type action without delay. Establishment of honest Interim government, permanent disqualification of those found guilty of nepotism and corruption, all those who fall under NRO! Free and fair elections held by December 2013. All those political parties that fail to get mininum of 33 percent electoral vote be asked to join one the regular party with more than 33% vote. Thus number of political parties reduced to no more than five. Otherwise let the present government along with her cronies keep ruling and the nation die a miserable death at their hands. Two positions can take a joint decision and save the nation, can the COAS and CJ reach an agreement for the Integrity of our nation.

Now another source of instability has been introduced in our political milieu, the SC along with military and agencies. In 1954 one wrong decision set the political decay in motion, and in 1958 AyubKhan without reason userped power and set the tradition for military interference, from which we cud never recover. I bet only this govt passed 4 yrs and all next govt wud never pass more than one years and next election again a hung parliament and a power hungry SC . I m 100000000% sure nothing will change, rather it will worsen.

  12. Another black day in the judicial history of Pakistan. Familygate Chief Justice has delivered a judgement which is against the basic principles of Constitution and politics. Judiciary has entered into Parliamentary domain. It is the Parliament's job to elect or remove a Prime Minister. Iftikhar has highlighted the standard set by judges like Maulavi Mushtaq & Anwar. If Iftikhar had an iota of respect, he should have resigned after Familygate. Perhaps respect is not in his dictionary of ethical values.

Parliamentarian (no matter from which party they belong) should at least unit together – (we all see how Lawyers are united, how Media is supporting each other, and how Army safeguards their breed) – this time Judiciary has crossed its domain, and this decision will definitely be taken up again in coming years as it has done a tremendous damage to the Parliament (it is an alarming situation for all upcoming Prime Ministers like Imran Khan, Nawaz Sharif and who knows who will be penalized in future on same pretext as Gilani has been mis-treated and insulted – Afterall he was the elected PM of this poor country – Judges these days are too sensitive about Contempt of courts – but ironically they themselves have committed "Contempt of Peoples Vote" and Judges might have to payback with interest in coming years if not days!!!!
