SC notices ‘Ridicule of Judiciary’

Maintaining that Tuesday’s press conference by real estate tycoon Malik Riaz Hussain had brought the “judiciary into ridicule”, a three-member bench of the Supreme Court on Wednesday took suo motu notice of the briefing and issued show-cause notice to Riaz over his latest allegations against the chief justice of Pakistan and his son Dr Arsalan Iftikhar.
The bench comprised Justice Mian Shakirullah Jan, the senior-most judge of the apex court, Justice Tariq Parvez and Justice Amir Hani Muslim, who put Malik Riaz on notice on a note put forward by SC Registrar and a separate plea moved by Chaudhry Ashraf Gujjar, the former president of Islamabad High Court Bar Association.
Earlier in the day, the normal proceedings of all benches were suspended in the morning and an informal emergency meeting was held at the chambers of the chief justice of Pakistan that was attended by all 12 judges of the apex court present in the federal capital.
A source said the chief justice took his colleagues into confidence over the allegations levelled against his family during the meeting and said he had decided not to include himself in court proceedings until the situation returned to normal.
However, all judges advised the CJP not to do so and rather take a suo motu notice of the press conference held by Malik Riaz, as the matter was of grave concern as the tycoon had brought the entire judiciary into ridicule. The source added that the meeting later unanimously decided to take suo motu notice. Following the full court meeting, the chief justice issued orders at around 2pm for suo motu notice of the fresh allegations levelled by Malik Riaz and a three-judge bench was formed to hear the case.
During hearing of the case at 3:30pm, Justice Mian Shakirullah Jan read out the Urdu transcript of Malik Riaz’s conference.The bench said Malik Riaz had shown disrespect for the judiciary and caused obstruction in the administration of justice. The bench said in its order that prima facie Malik Riaz had attempted to ridicule the court and the judges. The bench issued notices under Article 204 of the constitution, read with Section 3 of Contempt of Court Act 2003 and section 17 of the Supreme Court Rules. The bench summoned Malik Riaz to appear on Thursday and explain why contempt of court proceedings should not be initiated against him. The bench rejected a plea by Ashraf Gujjar of placing Malik Riaz’s name on the Exit Control List. Justice Tariq Parvez said the court could not deprive anyone of his fundamental rights. The hearing was adjourned until today (Thursday).

  1. Supreme Court of Pakistan is making a mockery of itself . There will come a time when entire Pakistan will be in contempt.

    .
    If the court put out a gag order, it should be applied across the board — including Arsalan and, yes, in this case Iftikar.

    If the court asks for Malik’s tax documents, it should ask the same from Arsalan.

    Has Iftikar recused himself from the case? Then how come he is convening strategy session with the other 12 and 17?

  3. I am more interested in public hanging for these corrupt politicians than anything else. Hang one and see how quickly the rest will straighten out.

    • Why dont u include judges first. First of all judges because they are supposed to be like VALIES(Saints). If they also indulge in corruption like politicians and businessmen, then ww will have what we have been having for last 65 years. You and many high class people wont believe Arsalan story, but if we talk to ordinary man who has direct experience of judiciary, especially in rural areas, they will readily believe any corruption story about judges because have direct experience of judiciary.

        • What about corrupt judiciary? A rural person or an ordinary person readily believes the corruption stories about judges, because he has direct experience of this in his life, rather than many upper middle class people who rarely face these problems

          • My father with 03 master degrees served 42-years could not build a single house. My brother with Engg degree still jobless.

            How come a matric pass cleric drrives in bullet proof, owns plans, his son keeps 12+cars each worth 1 crore, spent 26 crore on CJ son luxuries and openly talks of using money.

          • Stev Jobs and Bill Gates were never corrupt, They never used wheels (payae) as did Riaz Malik to get the jobs done. Please do not equate Riaz with Stev etc.

  5. a big NO. I am sure the cheif justice cannot keep up his facade for long. Media is misinterpretting a case a between a businessman and arsalan whoes father is a CJP.

  6. Why M.R.H is set to destroy all he has worked for his entire life including himself. What purpose it serves even if he brings the CJ down. Money isnt the issue here. Makes absolutely no sense–right. Unless, someone behind the scenes is tightening noose around his beck, making him do things. He has been crying out for help. Pay attention to what he has said in his interviews. He is just a puppet in someone else’s hands, under extreme duress–struggling to save whatever he can by obeying his faceless masters. The CJ, the SC, and perhaps the COAS should take notice before it’s too late for all.

    • Why r u appealing to COAS Perhapes you r totally unaware of Pakistan's power structure in which agencies relating to establishment play dominant role even without knowledge of govt. These agencies work under someone I have referred heretofore.

  7. All judges need to be respected because of the office they hold. However, Iftikhar Chaudhry does not deserve any. His reality has been totally exposed. He must quite and face thorough investigations, at least for the sake of restoring respect of Supreme Court. Now that Malik Riaz has made some things public, I call upon him to share everything he knows with the nation. We are waiting for him to reveal everything. We need to know a lot more.

  8. The are more than 100000 people who put up the money to buy residential plots from Malik Riaz. for around 60 billion. Wait till they come after him. He will run away just like other thieves. Only way he can survive is for PPP to stay in power and that is looking unlikely if fair elections are held.

  9. What are the charges (not allegations) against Iftikhar Chaudry? can one of the jiayalas please explain. And be specific. No rambling please.

    • I am not a jiala. But the charges do not just relate to financial corruption, but political or mental corruption, and mental corruption is mother of financial corruption. Why Pakistan is facing crisis now is not the product of today, but due to the ORIGINAL SIN of an other judge Justice Munir who in 1954 declared unconstitutional removal of Prime Minister as valid and set in political rot from which we r unable recover. Justice Iftikhar was constantly interfering in affairs which were totally domain of the executive and has brought the country to a standstill. He is publicity hungry and instead of eliminating corruption in judiciary, started breeding ambitions for top slot, which in itself is corruption of mind. He had forgoten what his job actually was and started power politics.

    • Exactly as I thought. Not one single bone head jiayala could come forward and state the exact charges against Iftikhar Chaudry. His son may have done something immoral but how does that make the CJ responsible for his grown up adult son's actions.

        • Actually mental and political corruption is the mother of financial corruption. If we look at Pakistan's history, from 1947-1958 our leaders were not corrupt financially but they were corrupt and crooked politically and by their power-lust started the process which has now culminated into failure of the state. The seeds were sowed by those mentally corrupt leaders. As a descendant started financial corruption which has spread like a cancer in our power structure.

      • I replied to ur question and explained it in the light of Pakistan's history starting from 1954 when Supreme Court Judge first time dismissed Prime Minister and set in the political rot from which we could never recover. Corruption is not only financial, and this CJ cannot claim immunity from that. But more destructive is his political corruption and aspiration for top slot. He has interfered into affairs which r purely executive domain. This trend can irreparably damage the federation like 1954 actions of Justice Munir.

        • Like I said Noman, please no ramblings. Be specific. Your post does not answer my question. Instead, you are going back to 1948. Are you telling me that the charges against this CJ are that he is responsible for what Justice Munir did in 1854? I don't need you to shed a light on Pakistan's history. I just wanted you to tell me how Iftikhar Chaudry is responsible for his son's actions and what law has he broken in this very high profile case that he could be charged with. If you don't have an answer that ok. I don't either 🙂

  10. With every passing day CJ is losing his respect and credibility (Which I doubt were not left any more right from the day he resumed the office).He is just making fool of himself and all the people.

    @ Kamran about his challenge that if there are any charges against CJ. I would say that if Mr. Kamran and CJ has any moral courage, than start an independent investigation on the Reference filed by Pevaiz Musharraf on 09-03-2007 which till date has not come up in any court of law. I hope there are enough charges in this reference to satisfy you. By the way i am not a bone head jiyala of PPP as i would be happiest person when this government finishes its tenure.

    • Every one knows who is play back actor. We expect judges to be angles and every one else may do whatever he likes. The chief justice has stood tall in the past and would stand tall in the present and future as well. It is a matter of time just wait for few days.

      • We do not expect judges to be angles. What we are trying to say that they should stop pretending to be angles and their supporters should stop to portray them like angles and saints. As far as your point is that CJ stood tall in past, I would have been a great admirer of him if he had stood tall on 12-10-2012.

    • @PTBP. Lets not go back in history. Lets just stick with this case since thats waht everybody seems to be up in arms about. Again, my question is : What exactly did CJ do that is illegal and how is he responsible for his grown, adult son's action? Be specific. What he did in the past has nothing to do with whats being said about him now. I am no fan of CJ myself but I don't see why he is being berated for what his son did.

      • As you said in your earlier post that if Son of CJ has done something wrong how can we put blame on CJ. Same argument goes with PM Gillani, If his Son or ministers of his cabinet have done something wrong how can we blame him for this.

        And if we go by your logic that reference against CJ is a thing of past than why CJ has made the whole nation bound to one case of Zardari. That is also a thing of Past. If Zardari has done some thing illegal in his period as President, please tell us. Again I would stress that I would be last person to support PPP. I am just trying to answering your arguments.

        I am not accusing the CJ in this whole story, what I am trying to say that the principles he have set for All other people, specially Government official, he should stick to these principles when it has come down to him. But unfortunately it is not happening and it gives a chance to point fingers at him.

        It is not about if CJ has committed some crime or not or he is indulge in any wrong doings. The point is that when for last five years we have been listening the sermons of CJ and his supporters on the ethics, morality and how the government people, Agencies, Army, and Bureaucracy should be answerable to law, than why he is doing things which can be pointed out as something is fishy there.

        Chief spoke person of CJ during the Lawyers moment Mr. Aitzaz Ahsan is on record that he informed CJ about all this saga 6 months ago. Did he take any action? Answer is not.
        When the case start circulating in media, He took Suo moto and then included himself in the bench as well. Do you think it was right step? Clear case of conflict of interests.

        He asked for all the records of Tax returns of the Bahria town, For what reason? This is not a case of Tax evading or theft. If Bahria town is not paying taxes properly put them in jail and punish them accordingly. But, by bringing it up this in the Arslan,s case it makes people think why he is doing this?

        Registrar Supreme Court has made reservation for a room in Balochistan House for the stay of Mr. Arslan. Why??????????????????????????????

        IG Islamabad police has been asked to punish all the officers who came along Malik Riaz during his appearance in Supreme Court. How it is wrong on the side of Islamabad police by providing security to Malik Riaz as there was an imminent threat that Lawyers or other supporters of CJ could have attacked him. There are many examples of this happening in past.

        CJ has stepped down from the Bench hearing this case after the criticism in some circles, But how one can be sure that Justice will be done properly and there will be no influence of CJ on the judges sitting in the bench. Remember that all the sitting judges of Supreme court has taken oath for the faithfulness with Iftikhar Chaudhary. During the HAJJ Corruption case he has given remarks that Hamid Saeed Kazmi should resign from his post so he could not influence the proceedings of case. Does the same principle not apply on CJ”

        Malik Riaz has clearly shows his dissatisfaction on CJ hearing his case. Why CJ is still insisting on doing so?????????????????????

        When we say that CJ is the last hope for justice in this country than find some ways that he could stay in office till the” Qayamat”. Because all other people in this country are corrupt and that includes his fellow judges as well.

        • @PTBP. You are the first person that has made any sense in answering my question. Even though you did not mention what crime the CJ has committed that he should be charged with. I do agree with you that the CJ has exerted influence in his son's career. Unfortunately thats is how our system works. I am not condoning that behavior, I'm just stating the facts. You have made some very good points that needs to be explored further however this is not the place to resolve these issues. The leaders of the country (politicians, army, judiciary, beauracracy etc) have all let us down. We have given them powers to make decisions for us. Instead they have made decision that only benefit them and their families. Time to start holding everyone accountable.

Man like Malik riaz who got contacts with zardari, Mian brothers and musharaf was so stupid to get blackmailed by a 32 year old son.
