Madhyana case: LHC orders ATC to start hearing

The Lahore High Court rejected a request on Thursday to transfer the teacher torture case against former MPA Aslam Madhyana and others and ordered the Anti-Terrorism Court Sargodha to start the hearing of the case from June 14.
LHC Chief Justice Umar Ata Bandial passed the order on a petition filed by Nadeem Sarwar Madhyana seeking directions to transfer the case to another court in any other district. Earlier, the Sargodha District Bar president and general secretary appeared before the court and submitted that the bar will not create any hindrances during the hearing of the trial and assured of their co-operation.
The court directed the office bearers to cooperate for ensuring a smooth and fair trial and ordered ATC Judge Sargodha to start the hearing of the teacher torture case from June 14. The court adjourned further hearing of the plea till July 9.
The petitioner submitted that a case was registered against him and others, including Aslam Madhyana for torturing Nafees Ahmad khan, a teacher, and that it was pending with the Anti-Terrorism Court Sargodha.
He added that Nafees’s counsel Shahid Nazeer Khan also got an FIR registered at the Sajid Shaheed Road Police Station against him and others, while the case was pending.
The complainant’s counsel, being a member of the district bar exploited situation by instigating others, he alleged and said the counsel prevented other members from rendering any legal services to the petitioner and the others accused.
He requested the court to issue directions for transferring the case to any other court jurisdiction in any other district.
It is pertinent to mention here that the court, on its last hearing had ordered the Judge ATC to stop hearing the case.
Meanwhile, a division bench of the Lahore High Court on Thursday adjourned the hearing of MPA Aslam Madhyana’s bail application.
