The Lahore High Court on Wednesday stayed the proceedings of the case pending before the Anti-Terrorism Court, Sargodha against former MPA Aslam Madhyana and others for allegedly breaking the legs of a school teacher.
The court also summoned Sargodha District Bar president and general secretary on June 7 besides issuing a notice to the state.
Justice Umar Ata Bandial passed the order on a petition filed by Nadeem Sarwar Madhyana seeking directions to transfer the case to a court in another district.
The LHC also summoned the Punjab Persecutor General on June 07 to give his arguments regarding the transfer of Madhyana.
Earlier, the petitioner’s counsel submitted before the court that a case was registered against the petitioner and others on the instance of Nafees Ahmad Khan, a teacher, and that the case was pending with the Anti-Terrorism Court Sargodha.
However, Nafees’s counsel Shahid Nazeer Khan also got an FIR registered under section 365, 148 and 149 at the Sajid Shaheed Road Police Station against the petitioner and others while the case was pending, he added.
The complainant’s counsel, being member of the district bar, exploited the situation by instigating other people, the petitioner alleged, saying that the counsel had prevented other members from rendering any legal services to the petitioner and other people accused.
He pleaded the court to issue directions for transferring the case to another jurisdiction.
He also pleaded to stay the proceedings of the case till the final disposal of the petition.
The court after hearing the arguments stayed the proceedings and summoned the Sargodha District Bar president and general secretary and Punjab Prosecutor General.
