A division bench of Sindh High Court (SHC) Thursday suspended the order of the Administrative Judge (AJ) of National Accountability Court for filing a reference against Federal Minister Syed Khursheed Ahmed Shah within 30 days. The bench comprising Justice Maqbool Baqar and Justice Shafi Siddique after preliminary hearing also ordered issuance of notices to respondents for June 12. The counsel of the petitioner Senator Raza Rabbani and Saalim Salam Ansari contended before the bench that under NAB Ordinance 1999, filing of NAB reference is only on chairman’s direction and thus impugned order is in excess of jurisdiction by AJ of ACC. The petition was filed by Syed Khursheed Shah challenging the order of the Administrative Judge of NAB Court and turning down a request made by the National Accountability Bureau seeking closure of case against the petitioner on a complaint regarding alleged accumulation of illegitimate assets. NAB chairman, through a prosecutor, submitted that after completing the investigation against Khursheed Ahmed Shah on a complaint regarding possessing assets beyond his legal means, an investigation officer recommended closure of the matter saying no prima facie case was made out. The administrative judge disapproved the plea on May 12 and directed the NAB chairman to file a reference within 30 days.
