Punjab Pakistan Muslim League-Quaid Senior Vice-President and Federal Advisor on Industries and Production Muhammad Basharat Raja has said that the Supreme Court has already granted leave for appeal CA 94/2010 in Punjab Chief Minister Shahbaz Sharif’s dual membership case and Shabaz’s disqualification was sure in the final verdict.
In a statement issued here on Monday, he said the Punjab law minister should be aware of this, adding that chief He said that we request the Chief Justice of Pakistan that he should order hearing of this appeal so that the final verdict could remove any ambiguity in this regard.
Raja further said that why those claiming to respect the courts judgments in the centre do not adopt same attitude in Punjab as well? He said despite quite categorical orders of the Lahore High Court, the Punjab Assembly speaker had not referred the cases of 9 members of the provincial assembly for disqualification on changing their loyalties to the Election Commission, why PML-N do not see this contempt of the court orders? He said this politics of double standard should better be stopped as it is not going to work anymore.
Reportedly, a citizen, Shahid Orakzai, had filed an application in the Supreme Court stating that Shahbaz was elected from PP-48 Bhakkar on June 3, 2008, and later from PP-10 Rawalpindi on June 27. He stated that as per Article 223 clause 4 of the constitution whenever a person is elected for a second seat, his/her first seat is considered vacant. But, Shahbaz retained the seat of Bhakkar and resigned from the seat of Rawalpindi. As PP-48 Bhakkar was already vacant so Shahbaz Sharif lost his assembly membership when he resigned from the seat of PP-10 Rawalpindi.
