Referring to a statement of the federal law minister Farooq H Naek that a letter written by the Supreme Court’s assistant registrar to the National Assembly speaker, the Cabinet Division secretary and the Chief Election Commissioner was misuse of his powers, as he was not authorised to write the letter, the Supreme Court Registrar clarified on Sunday that all court orders, without any exception, are forwarded to the concerned authorities/departments for implementation and compliance. Accordingly, two orders dated 26.4.2012 passed in the Criminal Original Petition No. 6/2012 in Suo Moto Case No. 4/2010 (Contempt proceedings against Syed Yousaf Raza Gillani, the Prime Minister of Pakistan regarding non-implementation of NRO judgment dated 16.12.2009 reported as Dr Mobashir Hassan v. Federation of Pakistan (PLD 2010 SC 265)) were duly communicated to the concerned (including above-mentioned) authorities/departments for action/compliance, the Supreme Court Registrar Dr Faqir Hussain said in a statement issued here Sunday. “This is in line with the Supreme Court Rules 1980 and there is nothing irregular or improper in following this procedure”, the Registrar clarified. He said Supreme Court’s April 26, 2012 and December 16, 2009 orders were forwarded by the Supreme Court’s Assistant Registrar (Implementation) to the Speaker, National Assembly and Election Commission of Pakistan, etc, under the rules. Addressing a press conference here Saturday, Farooq H Naek had said that a letter written by the Supreme Court assistant registrar to the National Assembly speaker, the Cabinet Division secretary and the Chief Election Commissioner was misuse of his powers, as he was not authorised to write the letter. He had asked the Supreme Court to hold an inquiry into it.
