A 10-member special bench of the Supreme Court headed by Chief Justice Iftikhar Muhammad Chaudhry will today (Tuesday) decide on the application of former ambassador to the US Husain Haqqani, in which he requested the court to direct the memo commission to record his statement from abroad through video link, like it had recorded the statement of Mansoor Ijaz, the main character of the memo scam.
On Monday, when the special bench took up the application, Husain Haqqani’s counsel Asma Jahangir sough time, stating that she wanted to place on record certain documents concerning the matter. The court allowed her a day’s time and adjourned the hearing for today (Tuesday).
During the brief hearing, Asma stated that the memo commission was of the view that her client should appear in person before it to get his statement recorded. She said due to certain reasons, her client wanted to get his statement recorded from abroad through video link, like Mansoor Ijaz did.
She said her client was neither an accused nor any FIR had been registered against him, but the commission had still not allowed him to get his statement recorded from abroad via video conferencing.
Asma contended that the Supreme Court had not bound his client in its orders to get his statement recorded in person before the commission. She requested the court to direct the commission to record statement of his client from abroad via video link.
The chief justice then noted that the court could not interfere with the commission’s proceedings. He observed that the court’s orders should be respected.
Asma said not only the court’s orders, but the laws of the land should also be respected.
Naseer Bhutta, counsel for one of the petitioners, objected to certain derogatory words used in the application by Husain Haqqani and requested the court that those particular words should be expunged.
The chief justice told him that he might submit an application to that effect.
Earlier on March 29, the same bench had granted another six weeks to the memo commission to complete the probe into the memo controversy, however, did not take up Haqqani’s application, in which he had sought recording of his statement from abroad through video link.
The court had retained its previous order of summoning Husain Haqqani on a four-day notice.

  1. Unless, the judges grow a backbone, they will be treated like dirt. Every attorney is making them look like idiots and they keep on taking it. Their reputation has already taken a hit in the public opinion. Its because of their indecisiveness and lack of guts to implement the law in its letter and spirit. They have started to make a fool of themselves by making bold statements and then looking for a way to save face. Everytime they back down, its another blow to their credibility. It is becoming so obvious who is running the show and its certaily not the judges.

  2. WHAT??? No wonder judges are losing credibility by the day. Each day it becomes more and more obvious that judges are not in control. Lawyers are running the show and the judges just comply with lawyer's orders.
