Lahore High Court Chief Justice, Sh Azmat Saeed, on Wednesday, said that decisions in lower courts should be on merit to reduce number of cases in high court where people come when dissatisfied by the lower courts.
Talking to 23 In-Service Trainee District & Sessions Judges in the Punjab Judicial Academy at a get together meeting, he said that bail applications and other petty matters were pouring in higher courts against the decisions of District Judiciary in large numbers.
He said that decision in lower courts should be on merit, meeting all technicalities of law so that need for a remand or appeal against the decision should not arise.
“The year 2011 saw the highest institution of cases in Lahore High Court as a result of alarming dismissal ratio by the subordinate courts,” he said. He said that the judgments in courts should be consistent and in confirmative style so that divergent and conflicting judgements on a similar legal point should not disseminate.
The CJ asked the Session Judges to focus on removing artificial barriers and other delaying tactics leading to early disposal of cases.
He also stressed upon the judges not to make a number gain by disposal of cases hastily and they should always keep in mind the quality and perfection of judgments.
The SJ’s voiced concern over frivolous litigation, pertaining to 22-A, 22-B Cr.P.C. while acting as Justices of Peace due to less punishment under Section 382 PPC on filing such cases and drew the attention of the authority for its remedy. Director General Judicial Academy Justice (R) Tanvir Ahmad Khan threw light on the salient features of the course.
LHC Registrar Sohail Nasir, the Sessions Judge (Inquiries, Research & Development) Javed Rashid Mehboobi were also present on the occasion.
