CJP Iftikhar Chaudhry on Wednesday further extended re-employment period of Supreme Court (SC) Registrar Dr Faqir Hussain (BPS-22) for two years on usual terms and conditions.
The registrar was already working on contract basis and it was another extension, which was justified by an order of the CJP on basis of his ability and non-availability of his substitute. His previous extension was not seen by many among the legal fraternity as healthy exercise and they have expressed their opinions openly. The fraternity members also voiced their concerns over various occasions citing that the SC had bound the Establishment Division in Tariq Azizuddin’s case not to hire secretaries in BPS-21 and BPS-22 on ad hoc or contract basis, so the same precedent could be set in the apex court as well.
Former SCBA president Asma Jahangir was more vocal and said that all judicial posts should not be filled on ad hoc or contract basis. The statement from the SC said that the CJP had consulted four senior most SC judges over the issue and they were also shared the opinion that Faqir might be re-employed. He also discussed with the senior most judges the fact that in the absence of any eligible officer of the SC to be promoted to BPS-22, they might hire the services of an officer from the government department on transfer or deputation basis, but this option could not be exercised in view of the fact that any new officer would take time to get acquainted with the complex working of the apex court.
The SC registrar was also ex-officio secretary of the Judicial Commission of Pakistan, besides working as secretary of the Supreme Judicial Council. Justifying the decision the statement said, “No right of promotion of any officer of the Supreme Court is being affected because currently there is no officer in BPS-21 in Supreme Court Establishment. The extension in period of re-employment of Dr. Faqir Hussain is in line with the relevant Government Rules and judgment of this Court in PLD 2011 SC 277. Therefore, the Hon’ble Chief Justice of Pakistan ordered the further re-employment for two years of Dr. Faqir Hussain as Registrar Supreme Court of Pakistan in BPS-22 w.e.f. 25.03.2012,” a press statement said.
It further said, “His re-employment due to non-availability of suitably qualified/experienced, staff does not infringe upon the promotional prospects and rights of the other officers i.e. Additional Registrar and the Deputy Registrars of the Supreme Court Establishment.”
Very bad, it means there we are not preparing our replacements which is also responsibility of the departments in time. In my opinion we should give opportunities to our younger talent to explore them because in 90% cases, change always shows good results.
further more this is our bad lack since establishment of Pakistan that every one thinks that there is no replacement for him and his team, in this way, we loose to much new talent. For God sake please try to change this habit in major departments.
The Hon"ble Supreme Court should have acted upon its own orders regarding non-employment of retired persons. this is open nepotism.
Had PM appointed any one on same grounds, it would have been dubbed as …..
