The Lahore High Court on Monday granted bail to Dr Majid Naeem, former IT consultant of education boards, Punjab and accused of misappropriation, fraud and financial and professional irregularities in the process of computerisation of examination system of all Boards of Intermediate and Secondary Education of the province. The court also granted bail to Mian Tariq Masood, system analyst, Lahore BISE and directed the accused to furnish surety bonds worth Rs500,000. Justice Syed Mazahar Ali Akbar Naqvi was hearing the bail applications of the accused.
The petitioners’ counsel submitted the accused were arrested in a fake case registered under sections 409 and 420 on the complaint of Arshad Mahmood, Section Officer, Higher Education Department. He said the accused were falsely involved in the matter with malafide intentions. The counsel submitted that the FIR registered had no date and time and no reported witnesses; and was sans specific allegations as well.
He further contended that the inquiry report was based on an assumption as it did not present any sound and concrete evidence against the accused. He submitted that the senior special judge, anti-corruption, had dismissed the bail applications of the accused without any cogent reason. The counsel contended that the accused were innocent therefore, bail be granted to them. The court after hearing the arguments granted bail to the accused subject to furnishing of bail bonds.
MAKHAN SINGH CASE: Justice Manzoor Ahmad Malik of Lahore High Court on Monday directed the Ministry of Interior to file its reply by March 16 on petition seeking the release of Indian prisoner Surjit Singh, alias Makhan Singh, after completion of his jail term.
The judge was hearing the petition filed by Advocate Awais Sheikh seeking inclusion of Surjit’s name in the list of foreign prisoners languishing in Pakistani jails despite completing their jail terms. About Surjit, who is detained in central jail, Kot Lakhpat for long time, Justice Manzoor made it clear to the law officer that further delay in response would not be allowed.
The judge asked the law officer as to why he was not being released, despite the culmination of the sentence. The judge deferred the hearing as the reply of the interior ministry was not submitted. The petitioner has requested the court to issue directions to the secretary of foreign affairs and superintendent of Lahore Central Jail to include Surjit’s name in the list of foreigner prisoners who have already completed their jail term.
VOID AB INITIO VC: A division bench of the Lahore High Court on Monday set aside appointment of Malik Hussain Mubbashar as the Vice Chancellor of University of Health Sciences (UHS) declaring it illegal and void ab initio. The bench directed the Punjab Government to appoint the VC after observing due process of law under merit policy. Justice Shahid Saeed and Justice Abdul Waheed Khan handed this order on a petition filed by Sajid Hussain through his counsel Nasir Mahmood Quershi advocate challenging Mubbashar’s re-appointment as the vice chancellor after his retirement on reaching the age of superannuation.
The petitioner pleaded that the respondent was not eligible to meet the criteria for his appointment as vice chancellor, so his presence in office was without lawful authority. The petitioner pointed out that in order to benefit the respondent the maximum age limit for the UHS VC had been enhanced from 65 to 70 years as the respondent was of 66 years at the time of his re-appointment.
