Taking notice of media reports about the young doctors’ strike in Lahore against the suspension and detention of their seniors on account of spurious drugs, the Supreme Court (SC) on Thursday directed the health secretary and advocate general Punjab to appear before it today (Friday). On the court orders, court registrar Dr Faqir Hussain wrote a letter to the Punjab chief secretary and drawn his attention to the court orders passed on January 30, 2012 directing doctors not to strike and leave patients unattended. The registrar sent him a copy of the SC’s January 30, 2012 order to solicit the information and to submit the report today (Friday) and provide the names and designation of the doctors who striked and which doctor had been suspension and why?
It is pertinent to mention that the court in its January 30, 2012 order in a suo motu case into the death of heart patients under treatment in Punjab Institute of Cardiology (PIC) on account of spurious drugs had directed the competent authority concerned to proceed with a transparent enquiry under the law, fix responsibility and thereafter propose action.
All the doctors, officers and drug manufacturers were directed to fully cooperate with the enquiry which had to be concluded expeditiously. The court, however had directed that no such doctor or a person required in such investigation or enquiry will be arrested, if he voluntarily cooperated with the enquiry. It was also directed hat any doctor arrested in this regard will be released forthwith subject to his personal bonds to the satisfaction of the Deputy Registrar (Judicial) of Lahore High Court, Lahore.
The court had noted that doctors represented a noble profession and ailing patients needed care and attention. “It is not in consonance with the spirit of their noble calling to strike and leave patients unattended, the court had noted, adding that as in the event of their strike or boycott, the patients under treatment in PIC or any other hospital were likely to suffer and their fundamental rights including the right to life might seriously be compromised. The court had strictly directed that no doctor go on strike.
only one question for Judical system.how was chief justice restored, and how doctors head can be released?
